Customers using EveryCatch services agree to send Messages (including but not limited to text messages, SMS, WhatsApp, and commercial emails) only to recipients who have explicitly opted in to receive them. Sending unsolicited messages — including spam, junk mail, or bulk email — via the EveryCatch platform is strictly prohibited.
EveryCatch does not buy, sell, rent, or license contact lists (including email addresses or phone numbers), nor does it permit Customers to use contact data that has been purchased, scraped, or obtained without clear, recipient-specific consent. Use of such lists violates this policy and may result in suspension or termination of service access.
If a recipient list or contact is found to be in violation of this policy or the applicable Terms of Use, Customers may be required to reconfirm consent (a “permission pass”) or cease all messaging to that recipient or list.
Should any regulatory body or industry authority publish a list of addresses or numbers (such as a “do not contact” or “recycled numbers” list), EveryCatch reserves the right to block messages from being sent to those contacts. However, it is the Customer’s sole responsibility to ensure they comply with relevant laws and guidelines and to refrain from sending messages to prohibited or outdated contacts. EveryCatch shall not be held responsible for blocking or failing to block such communications.
Customers must ensure that all recipients have expressly opted in to receive messages via the communication channels being used. For any opt-in list employed through EveryCatch services, Customers must be able to provide clear documentation of consent, including but not limited to:
The original source of the contact
The opt-in method used
Date and time of sign-up
IP address
Originating website or page
Any disclosures shown during the sign-up process
Language used to obtain consent
Any additional data collected at time of opt-in
All emails sent through EveryCatch must include an active and visible unsubscribe link. Removing or disabling the opt-out functionality in marketing emails is a direct violation of this policy and may result in immediate account suspension or termination.
Customers may not use:
Rented or traded lists
Third-party acquired contacts
Email append data
Contacts sourced from opt-out-only mechanisms
Only contacts that have opted in specifically to receive communications from the Customer are permitted. EveryCatch reserves the right to audit Customer lists and campaigns to verify compliance with this policy.
